so far i have won 3/5 cases i have fought, i have very bad luck with cops, and honestly they always catch me for BS tickets not when i'm really doing a crime, so officers on this board please dont get mad---its chill really i dont care, it is what it is.... this one, i honestly stopped at the stop sign...i was going to do a fat burnout, and i reved it high then i was like "naw man, usually theirs hella cops around here"....10 seconds later... lights come up... i was like :wtf: u got to be kidding me :hmm: :hmm: did he read my mind ? :( is that a crime thinking of doing a burnout then changing your mind ? :wtf: apparently it is ! anyways i summited this in...hopefully i'll win this one ! :eek:hnoes:

yes i know i said i stalled the car when i really didnt..but hell if i tell the judge i was planning on laying a fat pone... hed have a good laugh and keep the ticket so i wont think those things.. :( ... but honestly... i told myself no.. and thats what should count... but i know cops/judges dont care about self control... :( :hmm:

I respectfully submit this written declaration to the Court pursuant to CVC 40902. I plead not guilty to the charge of violating 22450 vc.

On March 4th, at approximately 7:00 p.m., I was driving a rented 2007 Porsche Boxster, License #XXXXXX, southbound on Country Dr. I was in the right most lane, approaching a stop sign, with the cross street Lexington St.
I proceeded to the stop sign behind a mini-van. The mini-van stopped, so did I, then the mini-van proceeded. I went forward a few feet and stopped myself, and stalled at the stop sign. Then proceeded, with a slightly hard acceleration due to learning how to a manual transmission car.

I had traveled about 300 feet, and was about to make a left turn on a green light onto Fremont Blvd. when I see a police Officer put his sirens on. I was surprise, and I pulled over immediately on the right shoulder. Officer Brooks said I had ran a stop sign, to my surprise I was in a bit of a shock, since I had stopped and stalled the car, it took me longer then 3 seconds to proceeded forward in the clear intersection.

Officer Brooks, asked me if my drivers license was in great shape, I replied, that I have a violation in my record. Officer Brooks replied that he would let me go if my record is as I said. Officer Brooks returned and gave me a notice that my drivers license was suspended, which I replied that I find that weird, since I had court two weeks prior, and they did not mention anything to me nor had I gotten a notice from DMV. Officer Brooks said it’s to late, he cited me and asked if my passenger had a valid drivers license, which he replied yes. My passenger handed him, his drivers license to Officer Brooks whom checked it, and turned out clean.

Officer Brooks handed me the citation to sign and registration, insurance and said he would keep my drivers license and my passenger would have to drive. My passenger got in the drivers seat, and had a hard time driving a manual transmission, which I had to teach him within a few minutes in order to drive home. Officer Brooks noticed, that my passenger could not get the car rolling, which then he came and offer me to drive, I declined and my passenger got the car moving and drove the car and myself back home.

In summation:

I know for a fact that I did not violate the violating 22450 vc, since I stopped behind the mini-van and once again where I stalled the car at the stop sign. Perhaps the Officer thought I had ran it because of the slightly hard acceleration out of the stop sign, but it was due to being new at driving stick shift.

I hereby certify under penalty of perjury under the laws of the State of California that the foregoing declaration of facts is true and correct.

if you actually did come to a complete stop then you should be fine. The officr can not do anything about you revving your motor in court, if he cited you for "running a stop sign". You should also be fine considering you had a witness in the car with you that saw you "stall" the car at the stop sign.

I've learned one thing a looong time ago...never tell the truth. I know it sounds bad and the officers on this board are going to hate me for it, but whenever I told the truth, I'd get a big fat ticket. When I make up a nice bullshit story, I get off with a warning. I've tried both enough times to openly say it.

when I see a police Officer put his sirens on
I smiled when I read that one :) But I know what you meant...

But seriously, to be brutally honest, when you do a written declaration, what you say really doesn't matter that much (unless you do a terrible job, which you didn't.) Your explanation was solid - but it will come down to how good of a job the officer does on his end.

You'll just have to cross your fingers that his declaration gets lost in the city's mail system, or that he leaves out a crucial detail.

Good luck - it's a coin toss!

Dude, just tell yourself, YOU'RE NOT LYING. You're just telling the man what he wants to hear. Simple as that. Those 2 minutes will save you $400 MIN. F*ck your conscious, listen to Slim instead :D

My last 2 instances involved some for of reckless driving, and both times I was let off with just a simple warning. Make a nice story and STICK TO IT. Speak slowly and confidently, and both of you will leave happy.

There ya go. If you need to appear before a judge, get the dude involved in the convo. Ask him if he drives a stick, if he says yes, ask him how long it takes to stall and restart a car. if you can get the judge involved, he'll automatically start to like you.
