I respectfully submit this written declaration to the Court pursuant to CVC 40902. I plead not guilty to the charge of violating 22450 vc.
On March 4th, at approximately 7:00 p.m., I was driving a rented 2007 Porsche Boxster, License #XXXXXX, southbound on Country Dr. I was in the right most lane, approaching a stop sign, with the cross street Lexington St.
I proceeded to the stop sign behind a mini-van. The mini-van stopped, so did I, then the mini-van proceeded. I went forward a few feet and stopped myself, and stalled at the stop sign. Then proceeded, with a slightly hard acceleration due to learning how to a manual transmission car.
I had traveled about 300 feet, and was about to make a left turn on a green light onto Fremont Blvd. when I see a police Officer put his sirens on. I was surprise, and I pulled over immediately on the right shoulder. Officer Brooks said I had ran a stop sign, to my surprise I was in a bit of a shock, since I had stopped and stalled the car, it took me longer then 3 seconds to proceeded forward in the clear intersection.
Officer Brooks, asked me if my drivers license was in great shape, I replied, that I have a violation in my record. Officer Brooks replied that he would let me go if my record is as I said. Officer Brooks returned and gave me a notice that my drivers license was suspended, which I replied that I find that weird, since I had court two weeks prior, and they did not mention anything to me nor had I gotten a notice from DMV. Officer Brooks said it’s to late, he cited me and asked if my passenger had a valid drivers license, which he replied yes. My passenger handed him, his drivers license to Officer Brooks whom checked it, and turned out clean.
Officer Brooks handed me the citation to sign and registration, insurance and said he would keep my drivers license and my passenger would have to drive. My passenger got in the drivers seat, and had a hard time driving a manual transmission, which I had to teach him within a few minutes in order to drive home. Officer Brooks noticed, that my passenger could not get the car rolling, which then he came and offer me to drive, I declined and my passenger got the car moving and drove the car and myself back home.
In summation:
I know for a fact that I did not violate the violating 22450 vc, since I stopped behind the mini-van and once again where I stalled the car at the stop sign. Perhaps the Officer thought I had ran it because of the slightly hard acceleration out of the stop sign, but it was due to being new at driving stick shift.
I hereby certify under penalty of perjury under the laws of the State of California that the foregoing declaration of facts is true and correct.
